Limited Liability Policy

ACKNOWLEDGMENT OF RISKS AND ASSUMPTION OF RESPONSIBILITY

I acknowledge that participation in activities at Side Rail Collective (the "Collective"), including but not limited to use of private studios, workshop spaces, shared studio areas, gallery walks, collaborative art-making sessions, and other events, involves inherent risks and hazards.

I understand these risks may include:

  • Use of art tools, equipment, and materials that may cause injury

  • Exposure to art materials, chemicals, paints, solvents, and other potentially hazardous substances

  • Risk of cuts, burns, allergic reactions, or other injuries from art-making activities

  • Slips, falls, or other accidents in studio spaces and during events

  • Risk of property damage or theft

  • Interaction with other participants, artists, and members of the public

  • Activities in indoor and outdoor spaces during various weather conditions

RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in Collective activities, I hereby:

RELEASE, WAIVE, AND DISCHARGE the Collective, its owners, operators, members, employees, volunteers, instructors, visiting artists, and agents from any and all liability, claims, demands, actions, or causes of action arising from my participation, including but not limited to:

  • Personal injury, illness, or death

  • Property damage or loss

  • Any claims arising from the negligence of the Collective or other participants

ASSUME ALL RISKS associated with participation, whether known or unknown, foreseen or unforeseen, including risks that may arise from the negligence of others.

AGREE TO INDEMNIFY AND HOLD HARMLESS the Collective from any liability, claims, or expenses (including attorney fees) arising from my actions or participation.

SPECIFIC ACKNOWLEDGMENTS

Art Materials and Equipment

I understand that art-making involves potentially dangerous materials and tools. I agree to:

  • Use proper protective equipment when appropriate including but not limited to eye protection, gloves, masks, hearing protection. 

  • Ask for assistance and instruction if not familiar with the use of equipment or materials

Photography and Media

Please let us know if you are not comfortable  being photographed or recorded during Collective activities and for such images to be used for promotional purposes. 

Personal Property

I understand the Collective is not responsible for loss, theft, or damage to personal property. I participate at my own risk regarding my belongings and artwork.

GENERAL PROVISIONS

This waiver is governed by Washington State law. If any provision is found invalid, the remainder shall remain in effect. This agreement represents the complete understanding between the parties.

I HAVE READ THIS WAIVER CAREFULLY AND UNDERSTAND ITS CONTENTS. I SIGN THIS VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
